We Are Taking Legal Action

we-are-taking-legal-action We are taking legal action against the decision to conduct distance education in universities taken by the Council of Higher Education (YÖK) which exceeds its authority.

As the Association for Supporting Contemporary Life (ÇYDD), we work for the goal of creating a modern society through modern education and we filed a lawsuit on March 1, 2023, with the Council of State, requesting the suspension and cancellation of the execution regarding the distance education decision taken by the Council of Higher Education (YÖK) on February 17, 2023, by overstepping its authority.

The implementation of the transition of all higher education institutions to distance education constitutes an important obstacle to the support of contemporary society's goal with modern education, which is one of the main objectives of our statute. This unlawful decision directly concerns our association, which provides educational support to students in higher education institutions and in general to a large number of students at all levels of their education.

Since the authority to determine the form of education and training in higher education institutions was not explicitly given to YÖK in the law; the decision taken by exceeding the given authority on a matter that each higher education institution should evaluate and decide by its own bodies is unlawful and not in accordance with the principle of academic autonomy.

This decision was taken by the Council of Higher Education in order to reduce the destructive consequences of the earthquake we experienced as a nation and to ensure that the citizens who suffered from the earthquake could be accommodated in the student dormitories.  Distance education decision was taken despite the negative opinion of the education experts, without fully evaluating the effects, without giving the idea much thought, without making the necessary plans and programs; and it will prevent our young people from fully realizing their right to education.

According to the Higher Education Law No. 2547, "to educate students in line with their personal interests and abilities as citizens who have the knowledge, skills, conduct and general culture of a profession that will respond to the development and needs of the country and at the same time that will ensure their own livelihood and happiness" is among the objectives of higher education and the idea of prioritizing the state's need to accommodate earthquake victims by restricting university education should be evaluated from the point of public interest.

As the Association for Supporting Contemporary Life, we will continue to stand by our young people who are the guarantee of the contemporary future of our country.
